From what I have read, and even DOJ's website states this, there must be a conviction for a presidential pardon to occur. Almost all of Joey's political pardons are for people who have not been convicted of anything. That said, there are always loopholes that can be exploited in anything, and especially in law. These pardoned people are now living in a false sense of safety from prosecution. That's good, because when the hammer falls, 'shock and awe' will have nothing on what will befall them.
