Dave it was in 1804 in the Marbury v Madison decision that the Supreme Court invented out of thin air, as it is nowhere in the Constitution, the concept of "judicial supremacy". i.e. the idea that they were the last word on interpreting the Constitution. “You seem to consider the judges as the ultimate arbiters of all constitutional questions; a very dangerous doctrine indeed, and one which would place us under the despotism of an oligarchy.” ~Thomas Jefferson

The Supreme Court was supposed to be the judicial branch where there was thought and analysis of what congress passed and the President signed. The courts were not supposed to make laws. The President in issuing an executive order was supposed to be an interpretation of existing law already passed by congress, not a new law. The faults of what have happened would seem to be because the voters voted for politicians who don't seem to follow the constitution or have any understanding of the U.S. Constitution. The changes that need to be made are made through constitutional amendments, so why do we need to eliminate the constitution because some people feel that the Constitution was made up by old white men? (Justice Sonia Sottemeyer)
